Terms of Service

Your use of this service is governed by law and ethical standards common throughout the internet (see also, M3AAWG Sender Best Common Practices). This document contains the Terms and Conditions under which your use of this website and the Service are governed. Should you have any questions or concerns, please do not hesitate to contact us.

Section A: User's Acknowledgment and Acceptance of Terms

  1. By creating an "Account" and using the NationalBicycleTheftRegistry.com web site ("Service"), or any services of the National Bicycle Theft Registry, NBTR ("National Bicycle Theft Registry"), you are agreeing to be bound by the following terms and conditions ("Terms of Service"). IF YOU ARE ENTERING INTO THIS AGREEMENT ON BEHALF OF A COMPANY OR OTHER LEGAL ENTITY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND SUCH ENTITY, ITS AFFILIATES AND ALL USERS WHO ACCESS MY SERVICES THROUGH YOUR ACCOUNT TO THESE TERMS AND CONDITIONS, IN WHICH CASE THE TERMS "YOU" OR "YOUR" SHALL REFER TO SUCH ENTITY, ITS AFFILIATES AND USERS ASSOCIATED WITH IT. IF YOU DO NOT HAVE SUCH AUTHORITY, OR IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, YOU MUST NOT ACCEPT THIS AGREEMENT AND MAY NOT USE THE SERVICES.

  2. If National Bicycle Theft Registry makes material changes to these Terms, I will notify you by email or by posting a notice on my site before the changes take effect. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes.   3. "Content" on the Service is defined by the information Users input into the service. Users are defined as those who utilize the National Bicycle Theft Registry Service and agree to the Terms of Service. While National Bicycle Theft Registry prohibits some conduct and Content on the Service, you understand and agree that National Bicycle Theft Registry cannot be responsible for the content posted on the Service and you nonetheless may be exposed to such materials. You agree to use the Service at your own risk. Violation of any of the terms below will result in the termination of your Account and may result in legal action being taken against you if your conduct warrants the same.

  4. "Content" on the service is provided for informational purposes only. Due the open source nature of my reporting system, National Bicycle Theft Registry cannot and does not warrant its truth or accuracy. Before taking any action in regards to any Content you find at the National Bicycle Theft Registry you should contact your local law enforcement agency to insure a police report was actually filed and that a theft indeed did occur.

  5. Any information or content you store on the server must be true and correct. Providing false information is a crime under state and U.S. federal law, punishable by a fine and imprisonment. I report all offenders at the time I remove any Content that violates state and/or federal law.

Section B: Account Terms

  1. You must be a human who physically completes the registration process without the aid of automated software. I use special security software to detect automated use of my system. If, after using the website, you find that you can no longer access the domain it means my website detected unauthorized access and automatically banned your connection. If your IP is banned in error, please contact support and I will work to resolve your issue.

  2. You must provide a valid email address in order to complete the signup process. After signup my system will send a verification email to the inbox of the email address entered. New signups must respond to the email within 72 hours before their membership account can be activated.

  3. You are responsible for maintaining the security of your account and password. The National Bicycle Theft Registry cannot and will not be liable for any loss or damage from your failure to comply with your own security obligation.

  4. You are responsible for all Content posted and activity that occurs under your account (even when Content is posted by others who have accounts under your account or access to your account).

  5. You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright or trademark laws).

  6. The National Bicycle Theft Registry takes very seriously the integrity of the information contained in my database. It is a violation of law to provide false or misleading information. Any user posting false or misleading information will be reported to law enforcement and prosecuted to the fullest extent of law provides.

Section C: Modifications to the service

  1. National Bicycle Theft Registry reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.

  2. National Bicycle Theft Registry shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

Section D: Copyright and content ownership

  1. I claim no intellectual property rights over the material you provide to the Service. Your profile and the materials you upload remain your personal property and all content posted to my database is done so under the terms of your expressed permission National Bicycle Theft Registry may use and distribute globally any and all information you provide (with the exception of your personal identifying information, which will never be published on the website or released to third parties without your expressed permission or a proper order of law issued by a court of competent jurisdiction).

  2. Content that you upload to the server can and is viewed publicly, and setting your profile to be public will allow information you add to it to be viewed publicly. You agree to allow users of the website to view this Content.

  3. National Bicycle Theft Registry does not pre-screen Content, but National Bicycle Theft Registry and its designee have the right (but not the obligation) in their sole discretion to refuse or remove any Content that is available via the Service for any reason or no reason at all. In as much as I reserve the right to deny service to any person for any reason or no reason at all, you have the right to demand that your account be closed and that any information you posted to my database be completely removed from my servers for any reason or no reason at all. In honor of this right, I make available features that allow you to discontinue your account and delete all data you included in my database.

  4. You shall defend National Bicycle Theft Registry against any claim, demand, suit or proceeding made or brought against National Bicycle Theft Registry by a third party alleging that your Content, or your use of the Service in violation of this Agreement, infringes or misappropriates the intellectual property rights of a third party or violates applicable law, and shall indemnify National Bicycle Theft Registry for any damages finally awarded against, and for reasonable attorney's fees incurred by, National Bicycle Theft Registry in connection with any such claim, demand, suit or proceeding; provided, that National Bicycle Theft Registry (a) promptly gives you written notice of the claim, demand, suit or proceeding; (b) gives you sole control of the defense and settlement of the claim, demand, suit or proceeding (provided that you may not settle any claim, demand, suit or proceeding unless the settlement unconditionally releases National Bicycle Theft Registry of all liability); and (c) provides to you all reasonable assistance, at your expense.

Section E: General Conditions

  1. Your use of the Service is at your sole risk. The service is provided on an "as is" and "as available" basis.

  2. Support for National Bicycle Theft Registry services is currently only available in English, via email. Live support services with my technical or security team members is a paid service billable at the time the service is rendered.

  3. You understand that National Bicycle Theft Registry uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service. My dedicated servers are owned and hosted on the Ionos 1&1 infrastructure and made available to all persons of all nations who have Internet access capable of logging onto my website.

  4. You must not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with the Service, National Bicycle Theft Registry, or any other National Bicycle Theft Registry service with out proper permission.

  5. You agree not to sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by National Bicycle Theft Registry.

  6. I may, but have no obligation to, remove Content and Accounts containing Content that I determine in my sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.

  7. Verbal, physical, written or other abuse (including threats of abuse or retribution) of any National Bicycle Theft Registry customer, employee, member, or officer will result in immediate account termination. The same may also be considered to be false and misleading information, punishable by criminal offense within the State of Colorado and the United States of America.

  8. You understand that the technical processing and transmission of the Service, including your Content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

  9. You must not upload, post, host, or transmit unsolicited email, SMSs, or "spam" messages.

  10. National Bicycle Theft Registry does not warrant that (i) the service will meet your specific requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (v) any errors in the Service will be corrected.

  11. The failure of National Bicycle Theft Registry to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and National Bicycle Theft Registry and govern your use of the Service, superseding any prior agreements between you and National Bicycle Theft Registry (including, but not limited to, any prior versions of the Terms of Service). You agree that these Terms of Service and your use of the Service are governed under Colorado law.
